Terms of Service

1. Acceptance of Terms

By accessing or using the FitDesk platform, the FitDesk Terminal, OmniPass BLE hardware, or any associated native mobile applications (collectively, the "Services") provided by BERALYTICS SYSTEMS ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Services.

2. Description of Service

FitDesk provides a unified access control and SaaS billing CRM system for gym owners and their members. Our services include offline-resilient access control (via the OmniPass feature), automated attendance logging, and subscription management.

3. Account Registration & Security

• Gym Owners: You are responsible for maintaining the confidentiality of your administrator credentials and for all activities that occur under your account.
• Members: Access is provisioned via an encrypted WhatsApp token. Your data remains securely encrypted and stored locally on your device in compliance with zero-trust architecture.

4. Permitted Use

You agree to use the Services only for lawful purposes. You shall not attempt to reverse engineer, decompile, or bypass any of the security mechanisms, including the OmniPass BLE beacon handshakes or the encrypted QR token generation system.

5. Hardware & Availability

We strive for 100% uptime of our SaaS infrastructure. However, BERALYTICS SYSTEMS is not liable for interruptions in service caused by local hardware malfunctions, ISP outages, or improper installation of OmniPass BLE beacons. Our local-first architecture ensures that attendance logs are cached offline and synced when connectivity is restored.

6. Payments & Subscriptions

Gym owners utilizing our SaaS Billing CRM are subject to the subscription fees agreed upon during registration. Payments are processed securely via our integration with Razorpay. Failure to maintain an active subscription may result in suspension of access to the Owner Dashboard.

7. Limitation of Liability

To the maximum extent permitted by law, BERALYTICS SYSTEMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

8. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will provide notice of significant changes through the Owner Dashboard or via email. Continued use of the Services after such modifications constitutes your acceptance of the revised terms.
